Transcript from City Council Meeting
Gary Ward's Interpretation
This interpretation started this whole controversy.
Our Attorney, Steve Smith's Interpretation
"Treehouses are not prohibited under your current ordinance nor were they prohibited from being in the front yard under your old ordinance."
Scot Welch  "Let's show the nation a city that works with its citizens."
Mary Welch "Change of administration, change of interpretation."
Jehu Brabham
This treehouse inspired Jehu to talk about
McDonald's, Worldcom, Nixon, and campers.  The gavel fell.
"I can't assume that kind of liability."  (Jehu worries that he will be sued.)
"Gary, I think you did a good job." - Phil Fisher
Ken Dreher, City Attorney
(Proof that their decision was already made before our attorney presented our case.)
Clint Brantley "Do what's right"
 Herb Touchton!!!!
"And I do not believe that this particular structure is an accessory building nor is it intended to be covered by the ordinance that we have on file."
Vote on Gary Ward's Interpretation
"The motion carries six to one, Aldermen Touchton voting no"
Steve Smith, Appeal for Conditional Use
"This treehouse meets the city's requirements to be granted a conditional use because of what it promotes, what it stands for."
Scot Welch, This is a civil case, not criminal.
Jehu Brabham, Denied again with a pre-typed motion.
Phil Fisher
Mr. Fisher talks about outhouses, straw huts, bamboo huts, and smoke houses.
He also discusses a covenant over which the city has no jurisdiction.
"I had put together some conditions that would protect the children, protect the city, and protect the neighborhood.  But when I asked the question of the city attorney about the legality of what I have, as far as providing conditional use, the answer is, it's illegal."
                                                                         -Clint Brantley
DENIED The city would not even provide a legal opinion.
Final Vote
"The motion carries six to one with Mr. Touchton voting no."
