BY MAYOR AULTMAN: These items were brought forward from the Planning
and Zoning Commission. The first item is an appeal of the zoning
administrator's decision regarding the accessory building definition at 218
Kitchings Drive. Gary Ward, the zoning administrator, will handle
that.
BY MR. WARD: Thank you. Section 201 of the zoning ordinance defines an accessory building as any detached structure or use which is subordinate or incidental to the main building or dominant use of the lot or premises, excluding driveways, sidewalks, and fences. This building located at 218 Kitchings Drive, known as the Treehouse, does not provide the facilities for a family to occupy as does the main structure. It does not have a kitchen. It does not have toilet facilities in it. Therefore, it's my view that the building is incidental or subordinate to the main structure. Therefore, it would fall under the categories of an accessory building. Section 201 also defines a building as any structure having a roof supported by columns or walls and intended for the shelter, housing or enclosure of persons, animals, equipment, goods and materials. The Welches are appealing this interpretation to the board. |
