It's fun, cool and controversial. Five years ago, Scott and Mary
Welch took on this labor of love - a tree house for their children
and neighborhood children to enjoy.
However, in April, Clinton Zoning Commissioner Gary Ward told
them they'd have to take their tree house down.
The city says that the tree house is an accessory building,
which violates the city's zoning codes. The Welch's say that
before they started building the tree house, they checked with a
city official. They were told that building the tree house would
not be an issue.
Shortly after getting the green light, the city's ordinance
changed. No one bothered to tell the Welch's, until recently.
Mary Welch says, "All the neighbors have gotten
together. Since July 4th, 600 people have signed a petition asking
them to not take the tree-house down.
The fight is not over. With signatures in hand, the Welch's
made their case Tuesday night before Clinton's Planning and Zoning
Commission, hoping the commission would make a favorable
recommendation to the City's Board of Aldermen to allow the tree
house to stand.
A packed conference room stood by the Welch's. In the end, the
commission decided to not decide.
Commissioner Janet Sherer says she only received information on
the tree house just prior to the meeting and couldn't make an
educated recommendation. "I felt like something needed to
be done tonight and it could not be done on account of our getting
the literature too late and the only sensible thing to do would be
to turn it over to the mayor and Board of Aldermen."
A disappointed crowd accused the commission of passing the
buck.
Clinton's Mayor and Board of Aldermen will vote on the tree
house during their next meeting, which is on August 6.
