McGovern, M.D. Center for Environmental and Regulatory
Affairs will soon publish its fifth compilation of
stories of victims of regulatory and government abuse. The
publication highlights how regulations that are poorly
written and/or inflexibly enforced can overwhelm,

Judge does not make a decision yet
In the Hinds County Courthouse,
Treehouse attorney Steven Smith defends the treehouse calling
the city's action arbitrary and capricious. Judge Tomie
Green states that the ordinance does not regulate what is
between heaven and earth and that trees are legal structures.
Mayor Aultman tells WAPT news that she will pursue this
further if the decision is not to her liking while city
attorney, Ken Dreher, tells the court that the city wants to
keep the treehouse if found legal. These two city statements
are contradictory. A decision is expected late this week
or early next.
Clinton mayor Rosemary Aultman says, "Should the court rule
against the city we will appeal it, and I think you'll see
other cities join in the appeal because this has statewide
ramifications." Scot Welch replies that "a more
effective solution is to simply define treehouse in your
ordinance. But keep in mind that adults and children love
treehouses." |

Treehouse fate still
in limbo
The Welches and the city are now waiting on
Judge Tomie Green to set a date for oral arguments.
We are prepared to move forward as soon as
the judge sets a date, said Mayor Rosemary Aultman. Aultman said City Attorney Ken Dreher has
contacted Green's court administrator several times seeking a date for
oral arguments. The administrator told him Judge Green has two large
trials to complete and isn't ready to se a date just yet, she added.

Mayor Attempts to Deny Treehouse Owners
their Constitutional Right to a Fair Trial |

In the Hinds County Circuit Court on April 22 at 11:00
am, The Honorable Judge Tomie Green respectfully denied the
city's request to dismiss the Treehouse case. "I will
not deny their right to a fair trial on a technicality,"
ruled the Judge. Mayor Rosemary Aultman, Ken Dreher and Sharbert Lott
represented the city. |
